Industrial Action/Strikes/Lock-outs

Thankfully, industrial action in Germany remains a rare occurrence. This could soon change as the Federal Employment Court has abandoned in 2010 the principle that only one set of collective agreements is applicable in a company. Whenever industrial action is threatening or commenced, the very survival of the company is often at strike. We advise and represent companies in preparing for strike situations or warding off strike measures initiated by the unions. In the dispute over pay scale between Deutsche Bahn and the locomotive drivers union GDL in 2007, our Employment Group partner Heiko Langer helped to obtain an injunction that led to the immediate end of the strike.
